（一）進(jìn)行商標(biāo)查詢。申請(qǐng)人應(yīng)調(diào)查是否已注冊(cè)相同或類似商標(biāo)。可在德專利商標(biāo)局慕尼黑總部、耶拿辦事處和柏林技術(shù)信息中心的商標(biāo)注冊(cè)大廳以及該局網(wǎng)站免費(fèi)查詢。也可向位於該國(guó)24個(gè)大中城市的專利信息中心查詢，四周可出結(jié)果，收費(fèi)500歐元（增值稅另付）。

（二）遞交注冊(cè)申請(qǐng)。注冊(cè)書式可從德專利商標(biāo)局網(wǎng)站下載，除集體商標(biāo)（協(xié)會(huì)標(biāo)志）外，均使用編號(hào)W7005的標(biāo)準(zhǔn)申請(qǐng)表。根據(jù)填表指南，填寫以下內(nèi)容：郵寄地址、申請(qǐng)人及代理人姓名與地址、該商標(biāo)說明性文字與圖片、所屬種類（分文字、圖案、聲音、三維、線條和其他商標(biāo)六類）及按《商標(biāo)注冊(cè)用商品和服務(wù)國(guó)際分類表》順序填寫的使用該商標(biāo)的商品與服務(wù)目錄。申請(qǐng)時(shí)不得附加樣品。

已在中國(guó)國(guó)注冊(cè)的商標(biāo)在德享有“外國(guó)優(yōu)先權(quán)”，可將在中國(guó)（原屬國(guó)）注冊(cè)時(shí)間申請(qǐng)為在德注冊(cè)時(shí)間。填表時(shí)應(yīng)在相應(yīng)欄目注明在我國(guó)注冊(cè)時(shí)間及注冊(cè)號(hào)，國(guó)內(nèi)注冊(cè)證等復(fù)印件最遲在申請(qǐng)德國(guó)商標(biāo)2個(gè)月內(nèi)補(bǔ)交。如我企業(yè)之前6個(gè)月內(nèi)在德聯(lián)邦司法部公布的展覽會(huì)上，展出使用該商標(biāo)的商品或服務(wù)，享有“參展優(yōu)先權(quán)”，可申請(qǐng)將展覽的第一天作為在德注冊(cè)時(shí)間。展會(huì)名錄在聯(lián)邦司法部定期出版的《專利、樣品及標(biāo)識(shí)》雜志上公布。

未使用德語填寫的表格，應(yīng)在1個(gè)月內(nèi)補(bǔ)交德國(guó)宣誓翻譯的翻譯文本或經(jīng)德律師認(rèn)證的翻譯件。

（三）繳納費(fèi)用。德國(guó)專利商標(biāo)局收到申請(qǐng)書件后，登記申請(qǐng)日期，編定申請(qǐng)?zhí)?#xff0c;向申請(qǐng)人發(fā)出受理通知書及《收費(fèi)通知單》。申請(qǐng)人應(yīng)在3個(gè)月內(nèi)按數(shù)額繳納，否則視為自動(dòng)撤回申請(qǐng)。交費(fèi)方式分三種：在德專利商標(biāo)局慕尼黑總部、耶拿辦事處及柏林技術(shù)信息中心繳納現(xiàn)金；向維登聯(lián)邦收費(fèi)處（Bundeskasse Weiden）轉(zhuǎn)帳匯款；授權(quán)德專利商標(biāo)局從有效帳戶上扣款。黑白商標(biāo)與彩色商標(biāo)收費(fèi)相同。不收取商標(biāo)年度管理費(fèi)。

（四）主管部門審查。確認(rèn)收到足額匯款后，德國(guó)專利商標(biāo)局確定使用該商標(biāo)的商品或服務(wù)所屬的類別，幷將申請(qǐng)信息輸入到該局DPinfo電子查詢系統(tǒng)，以便申請(qǐng)人隨時(shí)瞭解注冊(cè)進(jìn)展。檢查申請(qǐng)表是否符合填寫要求的同時(shí)，主要從以下方面審查是否具有可保護(hù)性：

1、是否具備商標(biāo)特性，可代表某種商品或服務(wù)，幷區(qū)別于其他商品或服務(wù)；

2、是否可用文字、圖案或綫條等進(jìn)行描述；

3、是否存在絕對(duì)保護(hù)障礙，如世界各國(guó)主權(quán)標(biāo)志（國(guó)旗、國(guó)徽等）、國(guó)際組織和公共機(jī)構(gòu)標(biāo)識(shí)以及代表商品服務(wù)形式、特點(diǎn)等的描述性名詞。

表格不規(guī)范之處通知申請(qǐng)人限期補(bǔ)正。初步裁定存在絕對(duì)保護(hù)障礙的，向申請(qǐng)人發(fā)出駁回通知單，申請(qǐng)人可在一定期限進(jìn)行答辯。如仍認(rèn)定存在該障礙，由德專利商標(biāo)局中高級(jí)官員（或同級(jí)技術(shù)人員）出具駁回裁定。申請(qǐng)人可在一個(gè)月內(nèi)向該局高級(jí)官員提出復(fù)審申請(qǐng)，如再次被駁回，可在一個(gè)月內(nèi)向德聯(lián)邦專利法院申請(qǐng)裁定，之后可繼續(xù)向聯(lián)邦法院（Bundesgerichtshof）申請(qǐng)最終裁定。

（五）注冊(cè)與公告。通過審查后，新商標(biāo)在德專利商標(biāo)局的商標(biāo)注冊(cè)簿上登記注冊(cè)，幷在該局網(wǎng)站電子版《商標(biāo)公告》上公布。申請(qǐng)人獲得《商標(biāo)注冊(cè)證》。在德注冊(cè)商標(biāo)平均耗時(shí)10至12個(gè)月。申請(qǐng)人繳納200歐元加急費(fèi)后，可申請(qǐng)6個(gè)月內(nèi)完成的快速審批。目前不能進(jìn)行網(wǎng)上商標(biāo)注冊(cè)。

( 1 ) Trademark inquiry. The applicant should investigate whether the same or similar trademarks have been registered. Free enquiries are available at the trademark registration lobby of the German Patent and Trademark Office headquarters in Munich, the Jena Office and the Berlin Technical Information Centre, as well as at the website of the Office. ( 2 ) Submitting registration application. The registration form can be downloaded from the website of German Patent and Trademark Office. Trademarks registered in China enjoy ' foreign priority ' in Germany and may apply for registration time in China ( the country of origin ) as registration time in Germany. When filling out the form, the registration time and registration number in China should be specified in the corresponding column, and the copies of domestic registration certificates should be filled in at least 2 months after the application for German trademarks. If our company within six months before the German Federal Ministry of Justice announced the exhibition, exhibit the use of the trademark of goods or services, enjoy ' exhibit priority ', you can apply for the first day of the exhibition as registration time in Germany. ( 3 ) Pay fees. Upon receipt of the application, the German Patent and Trademark Office shall register the application date, set the application number, issue the acceptance notice and the ' fee notice ' to the applicant. The applicant shall pay in accordance with the amount within 3 months, otherwise it shall be deemed to withdraw the application automatically. There are three modes of payment : payment of cash at the German Patent and Trademark Office headquarters in Munich, the Jena office and the Berlin Technical Information Centre ; transfer of remittances to Bundeskasse Weiden ; authorizes the German Patent and Trademark Office to deduct money from the valid account. Black and white trademarks have the same fees as color trademarks. No annual trademark management fee is charged.

 

( 4 ) The competent department review. After confirming the receipt of full remittances, the German Patent and Trademark Office determines the category of goods or services that use the trademark, and inputs the application information into the DPinfo electronic query system of the German Patent and Trademark Office, so that the applicant can understand the registration progress at any time. While checking whether the application form meets the filling requirements, it mainly examines whether it is protective from the following aspects :

1 、 Whether has the trademark characteristics, can represent some kind of goods or services, and different from other goods or services ;

2. Whether words, patterns or lines are available for description ;

3. Whether there are absolute barriers to protection, such as the world ' s sovereignty logos ( flags, national emblems, etc. ), international organizations and public institutions logos, as well as descriptive terms representing the form and characteristics of commodity services.

Where the form is not standardized, the applicant is notified of the time limit correction. If there is a preliminary ruling that there is an absolute protection barrier, the applicant shall issue a notice of rejection to the applicant, and the applicant may respond within a certain period of time. If the obstacle is still found, the decision shall be rejected by a senior official ( or equivalent technical staff ) of the German Patent and Trademark Office. The applicant can submit an application for review to the senior officials of the Bureau within one month. If it is rejected again, it can apply for a ruling to the Federal Court of Patent of Germany within one month, and then continue to apply for a final ruling to the Federal Court ( Bundesgerichtshof ).

 

( 5 ) Registration and announcement. After the review, the new trademarks are registered in the trademark registration book of the German Patent and Trademark Office and published in the trademark announcement of the website electronic version of the German Patent and Trademark Office. The applicant received a ' trademark registration certificate '. Registered trademarks in Germany take an average of 10 to 12 months. After the applicant has paid the extra urgent fee of EUR 200, it can apply for rapid approval within six months. Online trademark registration is not currently possible.
